Appalling Contractual Behaviour by a Local Government Entity:
Recently a small number of Members were advised, with minimal forward notice by a Local Government Entity, to “cease work and make safe” projects currently underway, all on the basis that a term works contract terminated on 30 June 2014, and was silent on the issue of works in progress at the time of contract cessation.
The contractors sought assistance from CCF on the matter, and after urgent legal advice was received, a formal and legal approach was made to council to reverse their decision and apologise for their unconscionable conduct.
Subsequently, CCF and the contractors met with senior officers of the municipality who formally and correctly re-instated the work orders through to the completion of the works underway.
Another case of unnecessary heartache for all involved that should not have occurred in the first place.
