CCFV Event Terms & Conditions of Purchase and Attendance

Before proceeding with your purchase, please read these Terms and Conditions carefully. You must not complete your purchase unless you agree with these Terms and Conditions.
1. Application of Terms and Conditions
a) In these Terms and Conditions, a reference to CCFV is to the CIVIL CONTRACTORS FEDERATION VICTORIA LTD, ABN 68 619 501 852, including its employees and authorised representatives, unless otherwise indicated.
b) A reference to the Venue is to the premises and/or venue to which a ticket relates.
c) A reference to a ‘Ticket’ is a reference the revocable licence in clause 7.a). Evidence of a Ticket may be considered to by a confirmation number, invoice receipt, or other such documentation CCFV determines to constitute evidence, in its absolute discretion.
d) Words like ‘holder’, ‘bearer’, and ‘purchaser’ will refer to You – as well as the reverse so that, a reference to ‘You’ refers to the ‘holder’, ‘bearer’, or ‘purchaser’, regardless of whether they are one or multiple persons. Where they are multiple persons, then a reference to ‘You’ is a reference to the persons or individual, rather than the group, except where context indicates otherwise.
e) By purchasing a ticket or other product (including car parking, accommodation, or merchandise) through CCFV (including from the Venue, online or over the phone) or through an authorised sales channel, you agree to comply with the Terms and Conditions.
f) By opting to purchase, allocate or possess the relevant tickets, you automatically agree to these Terms and Conditions. If you have problems with any of the clauses in this agreement, do not purchase tickets or try to enter the Event premises.
i) Without limiting any clauses in this agreement, these Terms and Conditions continue to apply even if a ticket is provided to a third party by any means and any subsequent holder of a ticket will be bound by these Terms and Conditions.
g) You enter into this agreement in Your own personal capacity, and also for and on behalf of:
i) any business or organisation which You represent, or which employs You; and
ii) any guest other person(s) for whom You complete registration for the Event,
h) (each of which is a Relevant Person) and You warrant that You:
i) have the express authority of all Relevant Persons to enter into this agreement on its/their behalf;
ii) have provided a copy of this agreement to all Relevant Persons; and
iii) have the consent of each Relevant Person (being an individual) to provide his/her personal information to Us.
i) Tickets may be sold or issued by CCFV in its own right or for a third party (for example, where an outside organisation is hiring a venue and has engaged CCFV to provide ticketing services for a performance in that venue).
j) Where CCFV sells tickets for a third party, CCFV has no control over, or liability for, the performance of the event. All ticketing complaints and claims, and your legal rights, are against the third-party presenter and not CCFV, except where CCFV is at fault or where you have a legal right against CCFV under the Australian Consumer Law, in accordance with this agreement.
k) Your ticket may be subject to additional booking terms, which will be notified to you prior to purchase. For example, if your ticket is to a timed ticketed exhibition, your ticket will only be valid for your nominated session time. Or if your ticket is to an event presented by a third party in one of our venues, your ticket may be issued subject to special booking terms applicable to that event or presenter. To the extent that there is any inconsistency between these additional booking terms and the Terms and Conditions, these Terms and Conditions will prevail.
2. PandemicSafe Settings
a) CCFV adopts special terms when there are PandemicSafe Settings in place in Victoria. These special terms are informed by a safety-first approach so that events are Pandemic safe for all workers and audiences and mitigate risks of community transmission to the public.
b) The PandemicSafe special terms are set out below (under this clause 2) and operate to supplement the Terms and Conditions.
2.1 House Rules and Other Conditions
a) There may be PandemicSafe ‘house rules’ applicable to your conduct at the Venue or event. We will communicate these to you at the time of ticket purchase. By purchasing your ticket, you are considered to have agreed to these ‘house rules’. You may be refused entry to the event or removed from the Venue if you do not comply with these house rules.
b) If the PandemicSafe Settings in Victoria change, there may be additional conditions applicable to your attendance at the Venue or event which are not known to CCFV at the time you purchase your ticket. We will use all reasonable efforts to communicate such additional conditions to you prior to the event or your attendance at the Venue. If you are unable to meet these additional conditions you may barred from entry to the Venue without compensation.
2.2 When you must stay at home
a) You must stay at home and must not attend the Venue or the event if:
i) you have test POSITIVE within the last 5 days or are required to self-isolate or quarantine under applicable PandemicSafe settings and the event falls within the isolation/quarantine period.; or,
ii) you have symptoms that suggest you have a contagious disease and may place others health at risk.
2.3 Ticket Remedy in relation to PandemicSafe Settings
a) We offer additional flexibility when PandemicSafe Settings are in place to encourage you to comply with any stay-at-home requirements.
b) You may be entitled to a Ticket Remedy if you fall into any of the following categories:
i) You are required to self-isolate or quarantine under applicable PandemicSafe settings and the event falls within the isolation/quarantine period.
ii) You are unable to travel to attend the event due to border restrictions.
c) For a Ticket Remedy to be considered, you must notify us at least 12 hours prior to the commencement of the event by emailing events@ccfvic.com.au. The following Ticket Remedy options may be available but can only be exercised by the original ticket purchaser and may only be awarded in CCFV’s absolute discretion. CCFV is not obligated to provide any Ticket Remedy.
i) Gift Voucher or Credit
CCFV may issue you with a credit to the value of the ticket to be redeemed for a future Event. Credit will be issued to the original ticket purchaser.
ii) Refunds
Except where required by law, including the Australian Consumer Law set out in Schedule 2 of the Australian Competition & Consumer Act 2010 (ACL), we will only provide refunds in our absolute discretion. Any requests for a refund must be made by emailing events@ccfvic.com.au. at least 12 hours prior to the commencement of the event and only by the original ticket purchaser.
We reserve the right to require further information or documentation to substantiate which circumstances apply before issuing a refund.
2.4 Pandemic safety when you attend our Venues and events
a) When you attend our Venues and events, you must comply with any Pandemic safety protocols or requirements notified to you by CCFV (including by way of signage at the Venue or by way of line markings on the floor). This includes complying with:
i) Hand hygiene requirements and the requirement to wear a face mask;
ii) Physical distancing requirements (including physical spacing requirements while queuing);
iii) Person limits for particular spaces and areas; or
iv) Person density requirements.
You acknowledge that anyone not adhering to these requirements may be in breach of directions issued by the Chief Health Officer for which penalties may apply.
b) Without limitation to clause 7 of the Terms and Conditions, you may be refused entry or required to leave the Venue or event if you:
i) refuse to comply with any Pandemic safety protocols or requirements notified to you by CCFV;
ii) refuse to comply with any reasonable health and safety directions given by Venue staff;
iii) have tested POSITIVE within the last 5 days or are required to self-isolate or quarantine under applicable PandemicSafe settings and the event falls within the isolation/quarantine period;
In these circumstances, Tickets will not be exchanged or refunded unless required by law (including the ACL).
3. Amendments to terms and conditions
a) Please note that CCFV reserves the right to make changes, revisions, and amendments, or add/remove sections from this set of terms and conditions - without any prior notifications to you. Such changes will be duly reflected on the CCFV website https://www.ccfvic.com.au/. These changes will relate back to the date of purchase of tickets.
b) By making a purchase through CCFV or an authorised sales channel, you agree to be bound by the Terms and Conditions that apply at the time of purchase, or the revised Terms and Conditions, where notice has been given to your prior to the Event.
4. Purchase of Tickets
a) Tickets are valid only when purchased through CCFV or from an authorised sales channel. CCFV reserves the right to cancel and not refund any ticket it reasonably believes has been bought or sold by an unauthorised seller. Kindly note that https://www.ccfvic.com.au/ and events@ccfvic.com.au are the sole authorised sources for purchasing CCFV Event tickets. If you obtain your ticket(s) from any other unauthorised source, you take on the risks of those tickets turning out to be counterfeit or reported to be stolen. CCFV has the right to dishonour such tickets and declare them as void.
i) If you have purchased a ticket from an unauthorised seller, you have no refund right from CCFV and may be at risk of no refund from that unauthorised seller.
b) The Event tickets delivered to you are not meant to be used for illegal reselling, copying, reproducing, or misrepresenting in any form. You cannot use the ticket(s) for any promotional/advertising purposes either (including sweepstakes and competitions) without our prior approval. Any proven record of such activities will result in immediate seizure and cancellation of your ticket(s).
i) Where CCFV has reasonable grounds to believe that you or a person associated with you is seeking to purchase tickets (or has previously purchased tickets) for the purpose of reselling those tickets at a premium to face value, CCFV reserves the right to block that person from purchasing further tickets, including blocking the web login or credit card/s associated with that person from transacting on CCFV's website.
c) In the interests of maintaining fair access to tickets, CCFV may place limits on the number of tickets that you can purchase. CCFV reserves the right to cancel and not refund any purchase exceeding those limits.
d) Use of automated means to purchase tickets is strictly prohibited. CCFV reserves the right to cancel and not refund any purchases where it is known or reasonably suspected that automated means have been used to purchase tickets.
e) Please note that tickets cannot be redeemed against cash, credits, or any other benefits, including other CCFV events.
f) In all cases of disputes between the ticket-bearer and the ticket-issuer, the decision of the latter will be deemed final.
4.1 Pricing and Payment
a) All prices are quoted in Australian dollars and are inclusive of GST (where applicable).
b) Tickets advertised at a particular price will be available at that price for a reasonable period of time and in reasonable quantities.
c) Prices are subject to change without notice.
d) Service fees and charges may apply to each purchase, and you will be notified of the applicable fee and/or charges prior to purchase.
e) You warrant that you have the authority to make payment for your purchase and that you own/hold or have express permission of the owner/holder of the credit card or other payment facility used to make the purchase.
f) If the amount paid by you for your purchase is incorrect for any reason (including ticket price and fee amount where the error was due to an error in a price posted on CCFV’s website or otherwise communicated to you or human error or technical malfunction), CCFV may cancel the order or the purchase and refund you the amount paid. Where the purchase was a ticket, CCFV may offer you a replacement ticket to you at the correct price.
g) You hereby agree to forego all types of surcharge claims - full or in part - and all claims and entitlements related to it. Please note that you purchase Event tickets on your own free will. As such, you do not have the right to initiate a chargeback claim or dispute on the provider of the credit card/debit card that had been used for the transaction. Further refund/return/cancellation requests will not be entertained either.
4.2 Delivery and Collection of Tickets
a) If you purchase tickets online or by email, or by phone, you will be given a confirmation number (or invoice number) to confirm your purchase. If you do not receive a confirmation number or are otherwise concerned that your purchase was not successful, you must contact us for confirmation of your purchase. CCFV takes no responsibility for incomplete purchases including where you have not received a confirmation number but have made no attempt to confirm the order.
b) Delivery of tickets will only be made upon receipt of full payment.
c) The event service will be deemed to have been delivered in its entirety as soon as the Event starts on the relevant date and time.
d) CCFV at its discretion reserves the right to not issue purchased and/or reissued tickets until one hour prior to the event advertised starting time.
5. Exchanges and Refunds
a) You will be entitled to a ticketing refund as required by law (including the Australian Consumer Law).
b) Provided that you purchased your ticket through CCFV or from an authorised sales channel, CCFV may, in their absolute discretion, grant a full or partial refund where:
i) The event is cancelled. (Note that where an event is rescheduled, reasonable endeavours will be made to ensure that you are offered seating in a similar location at the rescheduled event. If the event is not rescheduled, you will receive a full refund of the Ticket price and other Ticket charges.)
ii) The event is significantly relocated, and the nature of the experience and/or geographic location of the event is fundamentally altered by the relocation.
iii) An event is cancelled due to unforeseen circumstances that arise during the event, leaving the event uncompleted. (Note however that if a substantial proportion of the event is completed then, depending on the circumstances, CCFV may determine that a refund or exchange is not warranted in which case a refund or exchange right will not apply.)
c) In the case of event reschedules and relocations, the cut-off date will be 4 weeks from the date we advise you of the change unless the date of the new event is less than 8 weeks away, in which case you must apply for a refund prior to the mid-point between the announcement and the event. For example, if the new event is six (6) weeks away, you will have three (3) weeks in which to request a refund. CCFV will not entertain refund requests if your request is made after the cut-off date.
d) CCFV will not entertain a refund or exchange in the following circumstances:
i) Your ticket was free or complimentary.
ii) You did not enjoy the event or were dissatisfied with the performance at the event.
iii) You are unable to attend for reasons outside CCFV’s control including but not limited to; illness; illness of any person accompanying you to the event, or other person for whom you need to care; transport failure or delay; or where you choose not to attend the event.
iv) You arrive late to an event and are refused entry on the grounds that latecomers will not be admitted, or you are delayed admission or readmission until a suitable break in the performance.
v) You have been refused entry to or evicted from the event or Venue.
vi) An Event presentation is cancelled or replaced or if the items featured in an Event change, provided that you are made aware of the cancellation, replacement or change at the event.
vii) The advertised ticket price is changed.
viii) Additional seats or additional dates are released for presentation of the event.
ix) Tickets for an event are lost or stolen.
e) Refunds will be paid to the original ticket purchaser. Proof of identity and and/or proof of purchase may be requested.
f) Refunds will be processed using the original method of payment.
g) Refunds may not necessarily be available at the time the refund is requested.
h) Refunds will be limited to the face value of the ticket plus any service charges applied to the specific ticket purchase. Refunds will not include costs imposed by external suppliers that you were not obliged to incur but chose to incur, such as registered or express post fees, courier charges or insurance. Where tickets to multiple events are purchased in a single order, CCFV will not refund the service charge.
i) Unless required by law, CCFV will not reimburse you for auxiliary expenses incurred in connection with your attendance or non-attendance at an event, including a cancelled, rescheduled or relocated event. Auxiliary expenses include, but are not limited to, the cost of travel, meals, car-parking, child-care and accommodation. You may wish to take out ticket and/or travel insurance for those expenses.
j) Losses, if any, occurring due to foreign exchange fluctuations at the time of refunds, must be borne by the purchaser. CCFV cannot be, in any way, held liable for that.
5.1 Lost, Damaged, or Stolen Tickets
a) The bearer agrees to assume full responsibility of the Event tickets, once (s)he receives it. CCFV has no liabilities - financial, legal, or otherwise - in case the delivered tickets are stolen, lost, damaged, destroyed or rendered unusable in any other way.
b) Where tickets are lost, stolen, misplaced or damaged, CCFV may charge an administration fee to issue replacement tickets and may require proof of identity and purchase prior to issuing a replacement ticket.
c) CCFV may not provide replacement tickets where tickets are for general admission rather than allocated seating.
5.2 Force Majeure
a) If you are not able to access any particular section(s) of the venue due to delays, federal regulations, organiser policies, weather-related problems, emergencies, venue shutdown/evacuation or any other reason, you will not be eligible for any refunds or future credits.
b) If an Event is cancelled in its entirety due to any unforeseen circumstances, CCFV has the sole and absolute right to:
i) reschedule the event, or
ii) issue a partial/full refund, or
iii) not issue any refunds.
Please note that the decision of the issuer in such cases will be deemed final and binding.
c) If an Event is cancelled due to any factors or causes not in the control of the issuer, the latter may offer a partial or full refund, or postpone the event, or provide a comparable ‘make good’ option. These factors will be inclusive of, but not limited to, natural disasters, federal/state announcements, strikes, delays in production, and the like. Once again, the decision of CCFV will be considered final.
d) If an Event is rescheduled to other dates as a result of a Force Majeure Event, you will not be eligible for any refunds. In case the event is fully cancelled, the refund, if issued, will include ONLY the face value/printed value of the ticket(s). The bearer cannot, under any circumstances, claim refunds on shipping fees, processing fees, handling fees, and such other charges.
5.3 Merchandise and other products
a) Merchandise and other products (including food and beverage products) will not be refunded or exchanged except as required by law (including the Australian Consumer Law).
b) CCFV makes no representations as to the quality of third-party merchandise. You agree to indemnify CCFV of all claims or disputes arising out of third-party merchandise, including but not limited to any transactions with sponsors or other event attendees.
6. Gift Vouchers
a) Gift Vouchers and unused portions of Gift Vouchers should be spent within 36 months from the date of purchase, which is the "expiry" date of the Gift Voucher.
b) Gift Vouchers can be redeemed by emailing events@ccfvic.com.au.
c) Any unused balance will not be refunded or credited on expiry.
d) Gift Vouchers are non-refundable.
e) Gift Vouchers cannot be redeemed for cash.
f) If your order exceeds the amount of your Gift Voucher, you must pay for the balance with an alternate available payment method.
g) Gift Vouchers are considered cash. Replacements will not be issued for lost or stolen Gift Vouchers.
h) The standard fees and charges must be applied to all Gift Voucher transactions.
i) We may request an alternative form of payment if we have reason to believe that a Gift Voucher has been fraudulently obtained and is being used to make purchases.
j) We may provide purchasers of Gift Vouchers with information about the redemption status of Gift Vouchers.
6.1 Promotions and Competitions
a) If you received your ticket or other product as a prize, gift, donation or otherwise at no cost, these Terms and Conditions and the terms and conditions of the relevant promotion or competition apply to your use of the ticket.
7. Conditions of Entry
a) The ticket you purchase represents a revocable license for you to access the Event Venue at the specified time and date. The license includes the revocable right to attending the specified Event. This license can be revoked at any time by the issuer at its sole discretion, without any prior notifications or compensation options. If the license is revoked, you will not be granted entry at the venue.
b) Attendance at a Venue or an event and the right of admission is reserved by CCFV, the Venue and/or the presenter (as applicable).
c) By attending an event, you agree to the Venue’s conditions of entry.
d) You may be refused entry or required to leave the Venue or event for any valid reason, including but not limited to:
i) Where you cannot produce a ticket for the event.
ii) Where you produce a ticket that has been handled or dealt with in a way that is contrary to these Terms and Conditions.
iii) Where you refuse or cannot produce valid proof of identity if requested.
iv) Where you produce a ticket that is identified by CCFV as having been sold by an unauthorised seller.
v) Where you refuse to remain in the area or seat designated for you by CCFV.
vi) Where you have in your possession and/or refuse to surrender to CCFV’s staff any prohibited object or article including but not limited to dangerous items, photographic or recording equipment or food or alcohol that is not permitted to be brought into or used in that Venue.
vii) Where you refuse to undergo a physical search or a search of your possessions.
viii) Where you behave in a manner which causes or may cause property damage or that threatens or may threaten the safety of presenters, or other people, including as a result of intoxication.
ix) Where you behave in a manner that unreasonably interferes with other people’s enjoyment of the event, including through the use of cameras, mobile phones, personal computers, paging devices or other electronic devices.
x) Where you arrive late for an Event and CCFV determines that your admittance may interfere in other persons use and enjoyment of the Event.
xi) Where you are unwell or intoxicated.
xii) Where CCFV considers that there may be a health and safety risk to yourself or to others in your attendance at the Venue or the event, including as a result of illness, personal hygiene, your support needs or other relevant factors. Where you have support needs to attend the Venue or the event, we encourage you to contact us in advance of the event, so we can discuss these with you.
xiii) Where you otherwise breach these Terms and Conditions or fail to follow the reasonable directions of CCFV staff.
e) In these circumstances, Tickets will not be exchanged or refunded unless required by law (including the Australian Consumer Law).
f) You may be required to produce the ticket and a valid identification document (ID). By presenting an ID, you confirm that all details present on it are accurate and updated.
7.1 Minors, and Minimum Age
a) By purchasing the event tickets, you automatically confirm that you/the attendee(s) are of the ‘minimum age’ or older, at the time of buying the ticket(s). The ‘minimum age’ for attending an Event is 15, unless an alternative ‘minimum age’ is otherwise communicated to you by CCFV.
b) If it is proven beyond doubt at the venue that an attendee is below the ‘minimum age’, (s)he will not be granted entry to the Event. No refunds, full or partial, will be issued either.
c) Any person (regardless of age) interrupting the enjoyment of other visitors may be asked to leave an event and/or the venue.
d) Event Attendees may request to bring a child below the minimum age, at events@ccfvic.com.au. Any decisions made by CCFV will be determinative, and any easements may be revoked at any time, without reason. In all circumstances Children under 15 years of age must be accompanied by an adult at all times. Proof of age may be required by CCFV.
e) Any minor, under the age of 18, is required to be accompanied by a responsible adult.
i) If, for any reason, a minor’s responsible adult is evicted or refused entry, the minor may also be evicted or refused entry.
8. Virtual Events and Webinars
If You register to participate in an online Event, or participate in a physical Event by virtual (on-line) means, You agree that:
a) it is Your responsibility to ensure that You have appropriate technology, internet connectivity, and speed to participate;
b) We are not liable for any interruption, delay sound or picture quality problems You may experience because Your technology is inadequate, or any internet or power interruptions, internet speed, or other connectivity problems You may experience;
c) You are not entitled to a refund if You are unable to participate, or if the quality of Your participation is diminished, because of the matters referred to in paragraphs (8.a) and (8.b).
d) You will comply in all respects with this agreement and with any rules, protocols or other directions made by CCFV or the virtual session chair, whether published or issued in writing or orally;
e) If/when You post questions or messages to others participating by virtual means, your personal information may be shared with those persons; and
f) You warrant that the home/work environment in which You access the virtual component of the Event is safe and free of risk to Your health and safety.
9. Code of Conduct.
You must:
a) conduct Yourself in a reasonable, respectful, considerate and lawful manner;
b) not act, speak or otherwise communicate in a manner that is offensive, obscene or that reasonable persons may consider to be offensive or obscene;
c) if You consume alcohol, do so reasonably and responsibly;
d) not place the safety and health of any person(s) at the Event at risk;
e) not cause personal injury to, or defame, any person or damage the property of any person;
f) be respectful towards speakers and others expressing their opinions and refrain from causing a nuisance or interrupting or disrupting program content;
g) comply promptly with Our reasonable and lawful directions of Our authorised staff, Our contractors and of the relevant venue’s;
h) comply with Pandemic protocols as provided; and
i) ensure that each Relevant Person complies with the aforementioned.
10. Misconduct
a) Limitations on Use. By registering for a CCFV Event you agree not to sell, trade, transfer, or share your complimentary QR code or Nametag, unless such transfer is granted by CCFV.
b) Disruptive Conduct. You acknowledge and agree that CCFV reserves the right to remove you from the Event if CCFV, in its sole discretion, determines that your presence or behaviour create a disruption or hinder the Event or the enjoyment of the Event by other attendees.
c) Name-Tag Misuse. Attendees wearing Nametags from previous CCFV Events or falsified Nametags and/or sharing or swapping Nametags will be immediately ejected from the Event and banned from future Events. CCFV considers such conduct theft of service, trespassing, and fraud and will report violators to law enforcement authorities. If such conduct is discovered after an Event, violators will be invoiced according to onsite registration pricing and will be required to pay their invoice in full in order to avoid being reported to law enforcement authorities.
d) Photography, Recording, Live Streaming, and Videotaping. Attendees may not record or broadcast audio or video of sessions at CCFV Events. CCFV allows cameras on the show floor. Attendees may take pictures within the event for purposes of company or annual reports, company media pieces, marketing materials, etc.
e) Unethical/Non-Compliant Business Practices. CCFV reserves the right to deny admission to anyone who engages in or is reputed to engage in unethical or non-compliant business practices.
f) CCFV Events follow a common ‘zero-tolerance policy’ towards unauthorised drug usage or possessing weapons at the venue, and towards any type of behaviour/actions that can be interpreted as lewd or obscene. If you are found in possession of prohibited items at the Venue and/or if you indulge in any objectionable action, your participation in the event will be terminated immediately. Your event ticket(s) will become void from that point on.
g) In the event that CCFV determines that you have violated this clause 10, CCFV may cancel your license(s) for attendance, retain any payments made by you, report you to law enforcement authorities, and ban you from future CCFV Events.
11. Event Changes and Information
a) Particulars of an event may be changed without prior notice. Artists, performers, or presenters may be added, withdrawn or substituted for specific segments. Wherever possible, CCFV will advise consumers of event changes prior to the commencement of the segment, or at the event where prior notice is not possible.
b) Seating areas of a Venue may be closed with or without prior notice. If a ticketed seating area is no longer available, you will be relocated to another area of the Venue.
c) For some events, the artist or presenter may encourage audience members to actively engage with the presentation in some way, for example by standing up, waving or dancing. This may impact on visibility in some seating locations. You agree to indemnify CCFV from any perceived loss as a result of a presenter’s interaction with others.
d) In any of the circumstances set out above, Tickets will not be exchanged or refunded unless required by law (including the Australian Consumer Law).
12. Voluntary Assumption of Risk
a) You enter the Venue at your own risk.
b) You understand that attendance at any event and/or the Venue may carry with it certain dangers, including the risk of injury and damage to you or your property.
c) By attending the event and/or the Venue, you accept the risk of damage and loss (including property damage, personal injury, economic and consequential loss) howsoever arising (including by negligence) at the Venue. This includes damage or loss caused by the acts or omissions of other ticketholders, visitors, guests, and the employees and agents of CCFV or a presenter.
d) CCFV does not take any responsibility to personal/financial damages caused to you at the venue, or for any items lost/stolen/misplaced at the venue. Financial reimbursement claims on these counts will not be entertained.
13. Disclaimer of Warranties, Limitation of Liability
a) CCFV gives no warranties in respect of any aspect of the Event, or any materials related thereto or offered at the Event and, to the fullest extent possible under the laws governing this Agreement, disclaims all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, timeliness, and merchantability. The Event is provided on an “as-is” basis. The views, opinions, and positions expressed by the speakers, attendees, or sponsors at the Event are theirs alone and do not necessarily reflect the views, opinions, or positions of CCFV or any employee thereof. CCFV makes no representations as to accuracy, completeness, timeliness, suitability, or validity of any information presented by speakers, attendees, or sponsors at a CCFV Event and will not be liable for any errors, omissions, or delays in this information or any losses, injuries, or damages arising from its display or use. CCFV does not endorse, and expressly disclaims all liability relating to, any of the products or services provided by speakers, attendees, or sponsors.
b) Except as required by law, neither CCFV nor its affiliates shall be liable for any direct, indirect, special, incidental, or consequential costs, damages or losses arising directly or indirectly from the Event or other aspect related thereto or in connection with this Agreement.
c) The maximum aggregate liability of CCFV for any claim in any way connected with, or arising from, the Event or this Agreement, whether in contract, tort, or otherwise (including any negligent act or omission), shall be limited to the amount paid by you to CCFV under this Agreement.
d) To the extent permitted by law (including the Australian Consumer Law), CCFV is not liable to you for any loss, damage, injury, delays, additional expenses or inconvenience arising as a result of your attendance or non-attendance at the Venue and/or the event.
e) Where liability cannot be excluded or modified by law, including pursuant to the Australian Consumer Law, the liability of CCFV is limited to the minimum permitted by law.
14. Intellectual Property
a) All intellectual property rights in and to the Event, the Event content, and all materials distributed at or in connection with the Event are owned by CCFV, or the Event sponsors or speakers presenting at the Event. You may not use or reproduce or allow anyone to use or reproduce any trademarks or other trade names appearing at the Event, in any Event content or in any materials distributed at or in connection with the Event for any reason without the prior written permission of CCFV.
b) For the avoidance of doubt, nothing in this Agreement shall be deemed to vest in you any legal or beneficial right in or to any trademarks or other intellectual property rights owned or used under license by CCFV or any of its affiliates; nor does this Agreement grant to you any right or license to any other intellectual property rights of CCFV or its affiliates, all of which shall at all times remain the exclusive property of CCFV and its affiliates.
c) You do not have permission to film, record or photograph key parts of the event, including but not limited to, keynote speakers, unless CCFV otherwise authorises such.
15. Right to investigate
a) CCFV has the right to investigate if there has been any violation of these terms and conditions. In case of any conflicts, the decision of CCFV will be deemed final.
b) CCFV may invoice you for any costs incurred as a result of an investigation into your misconduct, if you are found to have been in breach of this agreement, including but not limited to, legal, travel, accommodation, investigator costs, and any other costs directly or incidentally incurred over the course of the investigation of your breach.
16. Use of likeness
a) CCFV has all rights to film, photo and video production of this event. Any data collected for marketing purposes from this event will be strictly in accordance with clause 17 and the Privacy Act 1988 (Cth).
b) By attending the Event you acknowledge and agree to grant CCFV the right at the Event to record, film, photograph, or capture your likeness in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to CCFV includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media.
17. Privacy Policy
a) You may be asked to provide personal information (including email address, postal address and other contact information) when making a purchase. Please ensure that you provide current, complete, and accurate information. If you do not provide personal information when requested, we may not be able to fulfil your order and may not be able to contact you to give you information about the event or to advise you of changes to the event including cancellation.
b) By making a purchase, you consent to the collection, use, disclosure and handling of your personal information as set out in this Privacy Policy.
c) You consent to Our collection, use and disclosure of Your personal information, including sensitive information as defined in the Privacy Act 1988 (Cth).
d) You also consent to Our use of Your personal information to let You know of future events or services that We consider You may be interested to attend.
e) You consent to the development and use of a Name-tag which may include personal information, including but not limited to, Name, email address, Business Name, Job Title.
f) You consent to Our publication of a delegate list and to disclosure of Your personal information, including "sensitive" personal information to:
i) Suppliers, to the extent We consider it necessary or desirable to enable them to provide appropriate goods or services to You (such as dietary or accessibility requirements); and
ii) Sponsors and exhibitors participating in the Event.
g) You may withhold consent for disclosure of Your personal information (but not in respect of Recordings) to sponsors and exhibitors during the registration process or by notifying CCFV via events@ccfvic.com.au.
h) By purchasing the Event Tickets, you are accepting the practices described in this privacy policy. These practices may be changed, but any changes will be posted, and changes will only apply to activities and information on a going forward, not retroactive basis. You are encouraged to review the privacy policy whenever you visit the site to make sure that you understand how any personal information you provide will be used.
i) Commitment to Data Security. Your personally identifiable information is kept secure. Only authorised employees, agents and contractors (who have agreed to keep information secure and confidential) have access to this information.
j) If You have any questions or wish to opt out of any consent provided in this Privacy Policy, do so by contacting the CCFV through events@ccfvic.com.au or by calling (03) 9588 7600.
18. Miscellaneous
a) CCFV’s failure to exercise any right provided for herein shall not be deemed a waiver of any further rights hereunder.
b) CCFV shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond CCFV’s reasonable control.
c) If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable.
d) This Agreement shall be governed by the laws of the Victoria and the parties shall submit to the exclusive jurisdiction of the Victorian courts.
19. Complaints and Feedback
a) You agree to not post, or otherwise distribute false, misleading, defaming, or disparaging information. You agree to relay all feedback through CCFV’s Event Surveys and other authorised feedback gathering techniques.

CCFV Event Terms & Conditions of Purchase and Attendance

Before proceeding with your purchase, please read these Terms and Conditions carefully. You must not complete your purchase unless you agree with these Terms and Conditions.
1. Application of Terms and Conditions
a) In these Terms and Conditions, a reference to CCFV is to the CIVIL CONTRACTORS FEDERATION VICTORIA LTD, ABN 68 619 501 852, including its employees and authorised representatives, unless otherwise indicated.
b) A reference to the Venue is to the premises and/or venue to which a ticket relates.
c) A reference to a ‘Ticket’ is a reference the revocable licence in clause 7.a). Evidence of a Ticket may be considered to by a confirmation number, invoice receipt, or other such documentation CCFV determines to constitute evidence, in its absolute discretion.
d) Words like ‘holder’, ‘bearer’, and ‘purchaser’ will refer to You – as well as the reverse so that, a reference to ‘You’ refers to the ‘holder’, ‘bearer’, or ‘purchaser’, regardless of whether they are one or multiple persons. Where they are multiple persons, then a reference to ‘You’ is a reference to the persons or individual, rather than the group, except where context indicates otherwise.
e) By purchasing a ticket or other product (including car parking, accommodation, or merchandise) through CCFV (including from the Venue, online or over the phone) or through an authorised sales channel, you agree to comply with the Terms and Conditions.
f) By opting to purchase, allocate or possess the relevant tickets, you automatically agree to these Terms and Conditions. If you have problems with any of the clauses in this agreement, do not purchase tickets or try to enter the Event premises.
i) Without limiting any clauses in this agreement, these Terms and Conditions continue to apply even if a ticket is provided to a third party by any means and any subsequent holder of a ticket will be bound by these Terms and Conditions.
g) You enter into this agreement in Your own personal capacity, and also for and on behalf of:
i) any business or organisation which You represent, or which employs You; and
ii) any guest other person(s) for whom You complete registration for the Event,
h) (each of which is a Relevant Person) and You warrant that You:
i) have the express authority of all Relevant Persons to enter into this agreement on its/their behalf;
ii) have provided a copy of this agreement to all Relevant Persons; and
iii) have the consent of each Relevant Person (being an individual) to provide his/her personal information to Us.
i) Tickets may be sold or issued by CCFV in its own right or for a third party (for example, where an outside organisation is hiring a venue and has engaged CCFV to provide ticketing services for a performance in that venue).
j) Where CCFV sells tickets for a third party, CCFV has no control over, or liability for, the performance of the event. All ticketing complaints and claims, and your legal rights, are against the third-party presenter and not CCFV, except where CCFV is at fault or where you have a legal right against CCFV under the Australian Consumer Law, in accordance with this agreement.
k) Your ticket may be subject to additional booking terms, which will be notified to you prior to purchase. For example, if your ticket is to a timed ticketed exhibition, your ticket will only be valid for your nominated session time. Or if your ticket is to an event presented by a third party in one of our venues, your ticket may be issued subject to special booking terms applicable to that event or presenter. To the extent that there is any inconsistency between these additional booking terms and the Terms and Conditions, these Terms and Conditions will prevail.
2. PandemicSafe Settings
a) CCFV adopts special terms when there are PandemicSafe Settings in place in Victoria. These special terms are informed by a safety-first approach so that events are Pandemic safe for all workers and audiences and mitigate risks of community transmission to the public.
b) The PandemicSafe special terms are set out below (under this clause 2) and operate to supplement the Terms and Conditions.
2.1 House Rules and Other Conditions
a) There may be PandemicSafe ‘house rules’ applicable to your conduct at the Venue or event. We will communicate these to you at the time of ticket purchase. By purchasing your ticket, you are considered to have agreed to these ‘house rules’. You may be refused entry to the event or removed from the Venue if you do not comply with these house rules.
b) If the PandemicSafe Settings in Victoria change, there may be additional conditions applicable to your attendance at the Venue or event which are not known to CCFV at the time you purchase your ticket. We will use all reasonable efforts to communicate such additional conditions to you prior to the event or your attendance at the Venue. If you are unable to meet these additional conditions you may barred from entry to the Venue without compensation.
2.2 When you must stay at home
a) You must stay at home and must not attend the Venue or the event if:
i) you have test POSITIVE within the last 5 days or are required to self-isolate or quarantine under applicable PandemicSafe settings and the event falls within the isolation/quarantine period.; or,
ii) you have symptoms that suggest you have a contagious disease and may place others health at risk.
2.3 Ticket Remedy in relation to PandemicSafe Settings
a) We offer additional flexibility when PandemicSafe Settings are in place to encourage you to comply with any stay-at-home requirements.
b) You may be entitled to a Ticket Remedy if you fall into any of the following categories:
i) You are required to self-isolate or quarantine under applicable PandemicSafe settings and the event falls within the isolation/quarantine period.
ii) You are unable to travel to attend the event due to border restrictions.
c) For a Ticket Remedy to be considered, you must notify us at least 12 hours prior to the commencement of the event by emailing events@ccfvic.com.au. The following Ticket Remedy options may be available but can only be exercised by the original ticket purchaser and may only be awarded in CCFV’s absolute discretion. CCFV is not obligated to provide any Ticket Remedy.
i) Gift Voucher or Credit
CCFV may issue you with a credit to the value of the ticket to be redeemed for a future Event. Credit will be issued to the original ticket purchaser.
ii) Refunds
Except where required by law, including the Australian Consumer Law set out in Schedule 2 of the Australian Competition & Consumer Act 2010 (ACL), we will only provide refunds in our absolute discretion. Any requests for a refund must be made by emailing events@ccfvic.com.au. at least 12 hours prior to the commencement of the event and only by the original ticket purchaser.
We reserve the right to require further information or documentation to substantiate which circumstances apply before issuing a refund.
2.4 Pandemic safety when you attend our Venues and events
a) When you attend our Venues and events, you must comply with any Pandemic safety protocols or requirements notified to you by CCFV (including by way of signage at the Venue or by way of line markings on the floor). This includes complying with:
i) Hand hygiene requirements and the requirement to wear a face mask;
ii) Physical distancing requirements (including physical spacing requirements while queuing);
iii) Person limits for particular spaces and areas; or
iv) Person density requirements.
You acknowledge that anyone not adhering to these requirements may be in breach of directions issued by the Chief Health Officer for which penalties may apply.
b) Without limitation to clause 7 of the Terms and Conditions, you may be refused entry or required to leave the Venue or event if you:
i) refuse to comply with any Pandemic safety protocols or requirements notified to you by CCFV;
ii) refuse to comply with any reasonable health and safety directions given by Venue staff;
iii) have tested POSITIVE within the last 5 days or are required to self-isolate or quarantine under applicable PandemicSafe settings and the event falls within the isolation/quarantine period;
In these circumstances, Tickets will not be exchanged or refunded unless required by law (including the ACL).
3. Amendments to terms and conditions
a) Please note that CCFV reserves the right to make changes, revisions, and amendments, or add/remove sections from this set of terms and conditions - without any prior notifications to you. Such changes will be duly reflected on the CCFV website https://www.ccfvic.com.au/. These changes will relate back to the date of purchase of tickets.
b) By making a purchase through CCFV or an authorised sales channel, you agree to be bound by the Terms and Conditions that apply at the time of purchase, or the revised Terms and Conditions, where notice has been given to your prior to the Event.
4. Purchase of Tickets
a) Tickets are valid only when purchased through CCFV or from an authorised sales channel. CCFV reserves the right to cancel and not refund any ticket it reasonably believes has been bought or sold by an unauthorised seller. Kindly note that https://www.ccfvic.com.au/ and events@ccfvic.com.au are the sole authorised sources for purchasing CCFV Event tickets. If you obtain your ticket(s) from any other unauthorised source, you take on the risks of those tickets turning out to be counterfeit or reported to be stolen. CCFV has the right to dishonour such tickets and declare them as void.
i) If you have purchased a ticket from an unauthorised seller, you have no refund right from CCFV and may be at risk of no refund from that unauthorised seller.
b) The Event tickets delivered to you are not meant to be used for illegal reselling, copying, reproducing, or misrepresenting in any form. You cannot use the ticket(s) for any promotional/advertising purposes either (including sweepstakes and competitions) without our prior approval. Any proven record of such activities will result in immediate seizure and cancellation of your ticket(s).
i) Where CCFV has reasonable grounds to believe that you or a person associated with you is seeking to purchase tickets (or has previously purchased tickets) for the purpose of reselling those tickets at a premium to face value, CCFV reserves the right to block that person from purchasing further tickets, including blocking the web login or credit card/s associated with that person from transacting on CCFV's website.
c) In the interests of maintaining fair access to tickets, CCFV may place limits on the number of tickets that you can purchase. CCFV reserves the right to cancel and not refund any purchase exceeding those limits.
d) Use of automated means to purchase tickets is strictly prohibited. CCFV reserves the right to cancel and not refund any purchases where it is known or reasonably suspected that automated means have been used to purchase tickets.
e) Please note that tickets cannot be redeemed against cash, credits, or any other benefits, including other CCFV events.
f) In all cases of disputes between the ticket-bearer and the ticket-issuer, the decision of the latter will be deemed final.
4.1 Pricing and Payment
a) All prices are quoted in Australian dollars and are inclusive of GST (where applicable).
b) Tickets advertised at a particular price will be available at that price for a reasonable period of time and in reasonable quantities.
c) Prices are subject to change without notice.
d) Service fees and charges may apply to each purchase, and you will be notified of the applicable fee and/or charges prior to purchase.
e) You warrant that you have the authority to make payment for your purchase and that you own/hold or have express permission of the owner/holder of the credit card or other payment facility used to make the purchase.
f) If the amount paid by you for your purchase is incorrect for any reason (including ticket price and fee amount where the error was due to an error in a price posted on CCFV’s website or otherwise communicated to you or human error or technical malfunction), CCFV may cancel the order or the purchase and refund you the amount paid. Where the purchase was a ticket, CCFV may offer you a replacement ticket to you at the correct price.
g) You hereby agree to forego all types of surcharge claims - full or in part - and all claims and entitlements related to it. Please note that you purchase Event tickets on your own free will. As such, you do not have the right to initiate a chargeback claim or dispute on the provider of the credit card/debit card that had been used for the transaction. Further refund/return/cancellation requests will not be entertained either.
4.2 Delivery and Collection of Tickets
a) If you purchase tickets online or by email, or by phone, you will be given a confirmation number (or invoice number) to confirm your purchase. If you do not receive a confirmation number or are otherwise concerned that your purchase was not successful, you must contact us for confirmation of your purchase. CCFV takes no responsibility for incomplete purchases including where you have not received a confirmation number but have made no attempt to confirm the order.
b) Delivery of tickets will only be made upon receipt of full payment.
c) The event service will be deemed to have been delivered in its entirety as soon as the Event starts on the relevant date and time.
d) CCFV at its discretion reserves the right to not issue purchased and/or reissued tickets until one hour prior to the event advertised starting time.
5. Exchanges and Refunds
a) You will be entitled to a ticketing refund as required by law (including the Australian Consumer Law).
b) Provided that you purchased your ticket through CCFV or from an authorised sales channel, CCFV may, in their absolute discretion, grant a full or partial refund where:
i) The event is cancelled. (Note that where an event is rescheduled, reasonable endeavours will be made to ensure that you are offered seating in a similar location at the rescheduled event. If the event is not rescheduled, you will receive a full refund of the Ticket price and other Ticket charges.)
ii) The event is significantly relocated, and the nature of the experience and/or geographic location of the event is fundamentally altered by the relocation.
iii) An event is cancelled due to unforeseen circumstances that arise during the event, leaving the event uncompleted. (Note however that if a substantial proportion of the event is completed then, depending on the circumstances, CCFV may determine that a refund or exchange is not warranted in which case a refund or exchange right will not apply.)
c) In the case of event reschedules and relocations, the cut-off date will be 4 weeks from the date we advise you of the change unless the date of the new event is less than 8 weeks away, in which case you must apply for a refund prior to the mid-point between the announcement and the event. For example, if the new event is six (6) weeks away, you will have three (3) weeks in which to request a refund. CCFV will not entertain refund requests if your request is made after the cut-off date.
d) CCFV will not entertain a refund or exchange in the following circumstances:
i) Your ticket was free or complimentary.
ii) You did not enjoy the event or were dissatisfied with the performance at the event.
iii) You are unable to attend for reasons outside CCFV’s control including but not limited to; illness; illness of any person accompanying you to the event, or other person for whom you need to care; transport failure or delay; or where you choose not to attend the event.
iv) You arrive late to an event and are refused entry on the grounds that latecomers will not be admitted, or you are delayed admission or readmission until a suitable break in the performance.
v) You have been refused entry to or evicted from the event or Venue.
vi) An Event presentation is cancelled or replaced or if the items featured in an Event change, provided that you are made aware of the cancellation, replacement or change at the event.
vii) The advertised ticket price is changed.
viii) Additional seats or additional dates are released for presentation of the event.
ix) Tickets for an event are lost or stolen.
e) Refunds will be paid to the original ticket purchaser. Proof of identity and and/or proof of purchase may be requested.
f) Refunds will be processed using the original method of payment.
g) Refunds may not necessarily be available at the time the refund is requested.
h) Refunds will be limited to the face value of the ticket plus any service charges applied to the specific ticket purchase. Refunds will not include costs imposed by external suppliers that you were not obliged to incur but chose to incur, such as registered or express post fees, courier charges or insurance. Where tickets to multiple events are purchased in a single order, CCFV will not refund the service charge.
i) Unless required by law, CCFV will not reimburse you for auxiliary expenses incurred in connection with your attendance or non-attendance at an event, including a cancelled, rescheduled or relocated event. Auxiliary expenses include, but are not limited to, the cost of travel, meals, car-parking, child-care and accommodation. You may wish to take out ticket and/or travel insurance for those expenses.
j) Losses, if any, occurring due to foreign exchange fluctuations at the time of refunds, must be borne by the purchaser. CCFV cannot be, in any way, held liable for that.
5.1 Lost, Damaged, or Stolen Tickets
a) The bearer agrees to assume full responsibility of the Event tickets, once (s)he receives it. CCFV has no liabilities - financial, legal, or otherwise - in case the delivered tickets are stolen, lost, damaged, destroyed or rendered unusable in any other way.
b) Where tickets are lost, stolen, misplaced or damaged, CCFV may charge an administration fee to issue replacement tickets and may require proof of identity and purchase prior to issuing a replacement ticket.
c) CCFV may not provide replacement tickets where tickets are for general admission rather than allocated seating.
5.2 Force Majeure
a) If you are not able to access any particular section(s) of the venue due to delays, federal regulations, organiser policies, weather-related problems, emergencies, venue shutdown/evacuation or any other reason, you will not be eligible for any refunds or future credits.
b) If an Event is cancelled in its entirety due to any unforeseen circumstances, CCFV has the sole and absolute right to:
i) reschedule the event, or
ii) issue a partial/full refund, or
iii) not issue any refunds.
Please note that the decision of the issuer in such cases will be deemed final and binding.
c) If an Event is cancelled due to any factors or causes not in the control of the issuer, the latter may offer a partial or full refund, or postpone the event, or provide a comparable ‘make good’ option. These factors will be inclusive of, but not limited to, natural disasters, federal/state announcements, strikes, delays in production, and the like. Once again, the decision of CCFV will be considered final.
d) If an Event is rescheduled to other dates as a result of a Force Majeure Event, you will not be eligible for any refunds. In case the event is fully cancelled, the refund, if issued, will include ONLY the face value/printed value of the ticket(s). The bearer cannot, under any circumstances, claim refunds on shipping fees, processing fees, handling fees, and such other charges.
5.3 Merchandise and other products
a) Merchandise and other products (including food and beverage products) will not be refunded or exchanged except as required by law (including the Australian Consumer Law).
b) CCFV makes no representations as to the quality of third-party merchandise. You agree to indemnify CCFV of all claims or disputes arising out of third-party merchandise, including but not limited to any transactions with sponsors or other event attendees.
6. Gift Vouchers
a) Gift Vouchers and unused portions of Gift Vouchers should be spent within 36 months from the date of purchase, which is the "expiry" date of the Gift Voucher.
b) Gift Vouchers can be redeemed by emailing events@ccfvic.com.au.
c) Any unused balance will not be refunded or credited on expiry.
d) Gift Vouchers are non-refundable.
e) Gift Vouchers cannot be redeemed for cash.
f) If your order exceeds the amount of your Gift Voucher, you must pay for the balance with an alternate available payment method.
g) Gift Vouchers are considered cash. Replacements will not be issued for lost or stolen Gift Vouchers.
h) The standard fees and charges must be applied to all Gift Voucher transactions.
i) We may request an alternative form of payment if we have reason to believe that a Gift Voucher has been fraudulently obtained and is being used to make purchases.
j) We may provide purchasers of Gift Vouchers with information about the redemption status of Gift Vouchers.
6.1 Promotions and Competitions
a) If you received your ticket or other product as a prize, gift, donation or otherwise at no cost, these Terms and Conditions and the terms and conditions of the relevant promotion or competition apply to your use of the ticket.
7. Conditions of Entry
a) The ticket you purchase represents a revocable license for you to access the Event Venue at the specified time and date. The license includes the revocable right to attending the specified Event. This license can be revoked at any time by the issuer at its sole discretion, without any prior notifications or compensation options. If the license is revoked, you will not be granted entry at the venue.
b) Attendance at a Venue or an event and the right of admission is reserved by CCFV, the Venue and/or the presenter (as applicable).
c) By attending an event, you agree to the Venue’s conditions of entry.
d) You may be refused entry or required to leave the Venue or event for any valid reason, including but not limited to:
i) Where you cannot produce a ticket for the event.
ii) Where you produce a ticket that has been handled or dealt with in a way that is contrary to these Terms and Conditions.
iii) Where you refuse or cannot produce valid proof of identity if requested.
iv) Where you produce a ticket that is identified by CCFV as having been sold by an unauthorised seller.
v) Where you refuse to remain in the area or seat designated for you by CCFV.
vi) Where you have in your possession and/or refuse to surrender to CCFV’s staff any prohibited object or article including but not limited to dangerous items, photographic or recording equipment or food or alcohol that is not permitted to be brought into or used in that Venue.
vii) Where you refuse to undergo a physical search or a search of your possessions.
viii) Where you behave in a manner which causes or may cause property damage or that threatens or may threaten the safety of presenters, or other people, including as a result of intoxication.
ix) Where you behave in a manner that unreasonably interferes with other people’s enjoyment of the event, including through the use of cameras, mobile phones, personal computers, paging devices or other electronic devices.
x) Where you arrive late for an Event and CCFV determines that your admittance may interfere in other persons use and enjoyment of the Event.
xi) Where you are unwell or intoxicated.
xii) Where CCFV considers that there may be a health and safety risk to yourself or to others in your attendance at the Venue or the event, including as a result of illness, personal hygiene, your support needs or other relevant factors. Where you have support needs to attend the Venue or the event, we encourage you to contact us in advance of the event, so we can discuss these with you.
xiii) Where you otherwise breach these Terms and Conditions or fail to follow the reasonable directions of CCFV staff.
e) In these circumstances, Tickets will not be exchanged or refunded unless required by law (including the Australian Consumer Law).
f) You may be required to produce the ticket and a valid identification document (ID). By presenting an ID, you confirm that all details present on it are accurate and updated.
7.1 Minors, and Minimum Age
a) By purchasing the event tickets, you automatically confirm that you/the attendee(s) are of the ‘minimum age’ or older, at the time of buying the ticket(s). The ‘minimum age’ for attending an Event is 15, unless an alternative ‘minimum age’ is otherwise communicated to you by CCFV.
b) If it is proven beyond doubt at the venue that an attendee is below the ‘minimum age’, (s)he will not be granted entry to the Event. No refunds, full or partial, will be issued either.
c) Any person (regardless of age) interrupting the enjoyment of other visitors may be asked to leave an event and/or the venue.
d) Event Attendees may request to bring a child below the minimum age, at events@ccfvic.com.au. Any decisions made by CCFV will be determinative, and any easements may be revoked at any time, without reason. In all circumstances Children under 15 years of age must be accompanied by an adult at all times. Proof of age may be required by CCFV.
e) Any minor, under the age of 18, is required to be accompanied by a responsible adult.
i) If, for any reason, a minor’s responsible adult is evicted or refused entry, the minor may also be evicted or refused entry.
8. Virtual Events and Webinars
If You register to participate in an online Event, or participate in a physical Event by virtual (on-line) means, You agree that:
a) it is Your responsibility to ensure that You have appropriate technology, internet connectivity, and speed to participate;
b) We are not liable for any interruption, delay sound or picture quality problems You may experience because Your technology is inadequate, or any internet or power interruptions, internet speed, or other connectivity problems You may experience;
c) You are not entitled to a refund if You are unable to participate, or if the quality of Your participation is diminished, because of the matters referred to in paragraphs (8.a) and (8.b).
d) You will comply in all respects with this agreement and with any rules, protocols or other directions made by CCFV or the virtual session chair, whether published or issued in writing or orally;
e) If/when You post questions or messages to others participating by virtual means, your personal information may be shared with those persons; and
f) You warrant that the home/work environment in which You access the virtual component of the Event is safe and free of risk to Your health and safety.
9. Code of Conduct.
You must:
a) conduct Yourself in a reasonable, respectful, considerate and lawful manner;
b) not act, speak or otherwise communicate in a manner that is offensive, obscene or that reasonable persons may consider to be offensive or obscene;
c) if You consume alcohol, do so reasonably and responsibly;
d) not place the safety and health of any person(s) at the Event at risk;
e) not cause personal injury to, or defame, any person or damage the property of any person;
f) be respectful towards speakers and others expressing their opinions and refrain from causing a nuisance or interrupting or disrupting program content;
g) comply promptly with Our reasonable and lawful directions of Our authorised staff, Our contractors and of the relevant venue’s;
h) comply with Pandemic protocols as provided; and
i) ensure that each Relevant Person complies with the aforementioned.
10. Misconduct
a) Limitations on Use. By registering for a CCFV Event you agree not to sell, trade, transfer, or share your complimentary QR code or Nametag, unless such transfer is granted by CCFV.
b) Disruptive Conduct. You acknowledge and agree that CCFV reserves the right to remove you from the Event if CCFV, in its sole discretion, determines that your presence or behaviour create a disruption or hinder the Event or the enjoyment of the Event by other attendees.
c) Name-Tag Misuse. Attendees wearing Nametags from previous CCFV Events or falsified Nametags and/or sharing or swapping Nametags will be immediately ejected from the Event and banned from future Events. CCFV considers such conduct theft of service, trespassing, and fraud and will report violators to law enforcement authorities. If such conduct is discovered after an Event, violators will be invoiced according to onsite registration pricing and will be required to pay their invoice in full in order to avoid being reported to law enforcement authorities.
d) Photography, Recording, Live Streaming, and Videotaping. Attendees may not record or broadcast audio or video of sessions at CCFV Events. CCFV allows cameras on the show floor. Attendees may take pictures within the event for purposes of company or annual reports, company media pieces, marketing materials, etc.
e) Unethical/Non-Compliant Business Practices. CCFV reserves the right to deny admission to anyone who engages in or is reputed to engage in unethical or non-compliant business practices.
f) CCFV Events follow a common ‘zero-tolerance policy’ towards unauthorised drug usage or possessing weapons at the venue, and towards any type of behaviour/actions that can be interpreted as lewd or obscene. If you are found in possession of prohibited items at the Venue and/or if you indulge in any objectionable action, your participation in the event will be terminated immediately. Your event ticket(s) will become void from that point on.
g) In the event that CCFV determines that you have violated this clause 10, CCFV may cancel your license(s) for attendance, retain any payments made by you, report you to law enforcement authorities, and ban you from future CCFV Events.
11. Event Changes and Information
a) Particulars of an event may be changed without prior notice. Artists, performers, or presenters may be added, withdrawn or substituted for specific segments. Wherever possible, CCFV will advise consumers of event changes prior to the commencement of the segment, or at the event where prior notice is not possible.
b) Seating areas of a Venue may be closed with or without prior notice. If a ticketed seating area is no longer available, you will be relocated to another area of the Venue.
c) For some events, the artist or presenter may encourage audience members to actively engage with the presentation in some way, for example by standing up, waving or dancing. This may impact on visibility in some seating locations. You agree to indemnify CCFV from any perceived loss as a result of a presenter’s interaction with others.
d) In any of the circumstances set out above, Tickets will not be exchanged or refunded unless required by law (including the Australian Consumer Law).
12. Voluntary Assumption of Risk
a) You enter the Venue at your own risk.
b) You understand that attendance at any event and/or the Venue may carry with it certain dangers, including the risk of injury and damage to you or your property.
c) By attending the event and/or the Venue, you accept the risk of damage and loss (including property damage, personal injury, economic and consequential loss) howsoever arising (including by negligence) at the Venue. This includes damage or loss caused by the acts or omissions of other ticketholders, visitors, guests, and the employees and agents of CCFV or a presenter.
d) CCFV does not take any responsibility to personal/financial damages caused to you at the venue, or for any items lost/stolen/misplaced at the venue. Financial reimbursement claims on these counts will not be entertained.
13. Disclaimer of Warranties, Limitation of Liability
a) CCFV gives no warranties in respect of any aspect of the Event, or any materials related thereto or offered at the Event and, to the fullest extent possible under the laws governing this Agreement, disclaims all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, timeliness, and merchantability. The Event is provided on an “as-is” basis. The views, opinions, and positions expressed by the speakers, attendees, or sponsors at the Event are theirs alone and do not necessarily reflect the views, opinions, or positions of CCFV or any employee thereof. CCFV makes no representations as to accuracy, completeness, timeliness, suitability, or validity of any information presented by speakers, attendees, or sponsors at a CCFV Event and will not be liable for any errors, omissions, or delays in this information or any losses, injuries, or damages arising from its display or use. CCFV does not endorse, and expressly disclaims all liability relating to, any of the products or services provided by speakers, attendees, or sponsors.
b) Except as required by law, neither CCFV nor its affiliates shall be liable for any direct, indirect, special, incidental, or consequential costs, damages or losses arising directly or indirectly from the Event or other aspect related thereto or in connection with this Agreement.
c) The maximum aggregate liability of CCFV for any claim in any way connected with, or arising from, the Event or this Agreement, whether in contract, tort, or otherwise (including any negligent act or omission), shall be limited to the amount paid by you to CCFV under this Agreement.
d) To the extent permitted by law (including the Australian Consumer Law), CCFV is not liable to you for any loss, damage, injury, delays, additional expenses or inconvenience arising as a result of your attendance or non-attendance at the Venue and/or the event.
e) Where liability cannot be excluded or modified by law, including pursuant to the Australian Consumer Law, the liability of CCFV is limited to the minimum permitted by law.
14. Intellectual Property
a) All intellectual property rights in and to the Event, the Event content, and all materials distributed at or in connection with the Event are owned by CCFV, or the Event sponsors or speakers presenting at the Event. You may not use or reproduce or allow anyone to use or reproduce any trademarks or other trade names appearing at the Event, in any Event content or in any materials distributed at or in connection with the Event for any reason without the prior written permission of CCFV.
b) For the avoidance of doubt, nothing in this Agreement shall be deemed to vest in you any legal or beneficial right in or to any trademarks or other intellectual property rights owned or used under license by CCFV or any of its affiliates; nor does this Agreement grant to you any right or license to any other intellectual property rights of CCFV or its affiliates, all of which shall at all times remain the exclusive property of CCFV and its affiliates.
c) You do not have permission to film, record or photograph key parts of the event, including but not limited to, keynote speakers, unless CCFV otherwise authorises such.
15. Right to investigate
a) CCFV has the right to investigate if there has been any violation of these terms and conditions. In case of any conflicts, the decision of CCFV will be deemed final.
b) CCFV may invoice you for any costs incurred as a result of an investigation into your misconduct, if you are found to have been in breach of this agreement, including but not limited to, legal, travel, accommodation, investigator costs, and any other costs directly or incidentally incurred over the course of the investigation of your breach.
16. Use of likeness
a) CCFV has all rights to film, photo and video production of this event. Any data collected for marketing purposes from this event will be strictly in accordance with clause 17 and the Privacy Act 1988 (Cth).
b) By attending the Event you acknowledge and agree to grant CCFV the right at the Event to record, film, photograph, or capture your likeness in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to CCFV includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media.
17. Privacy Policy
a) You may be asked to provide personal information (including email address, postal address and other contact information) when making a purchase. Please ensure that you provide current, complete, and accurate information. If you do not provide personal information when requested, we may not be able to fulfil your order and may not be able to contact you to give you information about the event or to advise you of changes to the event including cancellation.
b) By making a purchase, you consent to the collection, use, disclosure and handling of your personal information as set out in this Privacy Policy.
c) You consent to Our collection, use and disclosure of Your personal information, including sensitive information as defined in the Privacy Act 1988 (Cth).
d) You also consent to Our use of Your personal information to let You know of future events or services that We consider You may be interested to attend.
e) You consent to the development and use of a Name-tag which may include personal information, including but not limited to, Name, email address, Business Name, Job Title.
f) You consent to Our publication of a delegate list and to disclosure of Your personal information, including "sensitive" personal information to:
i) Suppliers, to the extent We consider it necessary or desirable to enable them to provide appropriate goods or services to You (such as dietary or accessibility requirements); and
ii) Sponsors and exhibitors participating in the Event.
g) You may withhold consent for disclosure of Your personal information (but not in respect of Recordings) to sponsors and exhibitors during the registration process or by notifying CCFV via events@ccfvic.com.au.
h) By purchasing the Event Tickets, you are accepting the practices described in this privacy policy. These practices may be changed, but any changes will be posted, and changes will only apply to activities and information on a going forward, not retroactive basis. You are encouraged to review the privacy policy whenever you visit the site to make sure that you understand how any personal information you provide will be used.
i) Commitment to Data Security. Your personally identifiable information is kept secure. Only authorised employees, agents and contractors (who have agreed to keep information secure and confidential) have access to this information.
j) If You have any questions or wish to opt out of any consent provided in this Privacy Policy, do so by contacting the CCFV through events@ccfvic.com.au or by calling (03) 9588 7600.
18. Miscellaneous
a) CCFV’s failure to exercise any right provided for herein shall not be deemed a waiver of any further rights hereunder.
b) CCFV shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond CCFV’s reasonable control.
c) If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable.
d) This Agreement shall be governed by the laws of the Victoria and the parties shall submit to the exclusive jurisdiction of the Victorian courts.
19. Complaints and Feedback
a) You agree to not post, or otherwise distribute false, misleading, defaming, or disparaging information. You agree to relay all feedback through CCFV’s Event Surveys and other authorised feedback gathering techniques.
